Rejoinder-affidavits are not included in the rules of procedure for the Ombudsman. And it was last January yet that I filed my reply-affidavit to which this was made. I couldn't believe my luck when I read the document. Coscolluela affirmed and confirmed the very core of my complaint in the Iloilo Convention Center: 1. That his architectural firm wasn't engaged by DOT and yet it acted as consultant for the project, preparing in the process its architectural and engineering design. As every architect knows, he can't perform this professional service to a client unless he has a contract of service with him. This is contained in the Architect's Code. 2. Coscolluela admitted that his contract to prepare the A&E design with Megaword was signed six months AFTER the deed of donation for the 1.7-hectare property was perfected. This reinforces my argument that the A&E design is not part of the donation. This is different from the conceptual design contained in the deed of donation. But Coscolluela said the decision of Megaworld to include the A&E as part of the donation is beyond his control. This demolishes the argument of Senate President Franklin Drilon, DOT secretary Ramon Jimenez and DPWH secretary Jesus Singsong that the A&E was the same thing as the conceptual design mentioned in the deed of donation. 3. Coscolluela found nothing wrong in his act of allowing Hilmarc's to alter, revise and amend its structural design submitted in the negotiated procurement. He found the technical proposal of Hilmarc's "not to be implementable as it did not conform to the original structural design and requirements." So he asked Hilmarc's to change it. Anybody familiar with RA 9184 knows this is a violation of the law. A bid that does not meet the financial and technical requirements of the contract is rejected outright. It is deemed "non-complying and unresponsive". But Coscolluela took it upon himself to ignore this mandate. He made a travesty of the law. I am thankful for Coscolluela for being honest and candid even as he insisted he did nothing wrong. That is understandable. He thought he was just doing his job. He didn't realise there's a law governing government procurements. I wouldn't dispute him if the ICC was funded by Megaword. But this involves government money. The law must be followed. I consider this as a God-given miracle. The rules provide for counter-affidavits and reply-affidavits to be filed within 10 days from receipt. Coscolluela received my reply-affidavit in the first week of February 2015. As to why he chose to still file this rejoinder-affidavit a good 45 days afterwards is a mystery. I am not complaining. His rejoinder-affidavit strengthens my case. I am grateful to him. Perhaps an invisible force led him to file this pleading which I consider the "final nail in the coffin."
