Arellano) of General Macario Sakay (A Patriot, Martyred Hero, Co-Founder of the Nationalista Party, and Murdered by Hanging in the Gallows by Fellow Filipinos! – DTT 02-01-2012 The Victim of Philippine Judiciary and the Supreme Court: General Macario Sakay – 4th President of the Republic of the Philippines, Ignacio Villamor - Filipino Judge Who Convicted Sakay With Death Penalty and First University of the Philippines President (US Colonial Period), First Chief Justice of the Supreme Court Cayetano Arellano Who Affirmed the Conviction of Death Penalty (FIRST DIVISION [G.R. No. 3621. July 26, 1907.] THE UNITED STATES, Plaintiff-Appellee, vs. MACARIO SAKAY, JULIAN MONTALBAN, LEON VILLAFUERTE, and LUCIO DE VEGA, Defendants-Appellants). The Judge: Ignacio Villamor (eventually became Associate Justice Ignacio Villamor; Tenure: May 19, 1920 - May 23, 1933. Appointed by: Woodrow Wilson Birthdate: February 01, 1863; Place of Birth: Bangued, The Supreme Court Chief Justice: Cayetano L. Arellano (March 2, 1847 – December 23, 1920) was the first Chief Justice of the Supreme Court of the Philippines under the American Civil Government. He was Chief Justice from 1901 until his retirement on April 12, 1920, making him the longest serving Chief Justice (Many historians doubt the legacy of Arellano, for being one of the persons who literally 'placed' the Philippines under American Rule, he was considered a lackey of the American rule in the Philippines. It was shown that he was pro-American from the start. The Decision: These Defendants were charged in the Court of First Instance of the Province of Cavite with having committed the crime of bandolerismo, as follows: “That the said Macario Sakay, Francisco Carreon, Julian Montalban, Leon Villafuerte, Lucio de Vega, Benito Natividad, Justiniano Ramos, Vicente Giron, Filomeno Peroy, Isabelo Despida, Felix Estacio, and Gregorio Porto, in and during the years 1902, 1903, 1904, 1905 and 1906, voluntarily, illegally, and criminally, organized bands of ladrones, in which organizations the said Macario Sakay was known as president, Francisco Carreon as vice-president, Julian Montalban and Leon Villafuerte as generals, Lucio de Vega as colonel, Benito Natividad, Justiniano Ramos, and Vicente Giron as majors; that the said bands of ladrones were each composed of more than three persons, armed with deadly weapons, and were organized by the accused for the stealing of carabaos, cattle, horses, rice, and other kind of personal property, and for other purposes, by means of force and violence; that the said bands of ladrones, organized commanded, and directed by the said accused, performed each and all of the aforementioned acts in the Province of Cavite, Batangas, Laguna, Rizal, and Bulacan; and that more especially they detained, tortured, mutilated, and purposely and treacherously killed some of the inhabitants of the said provinces. That the said accused, each and every one of them, cooperated and associated with said armed ladrones when the said bands operated under their command and performed the acts above related. All against the statute in such cases made and provided.” X X X X X X X X X X The attorneys for the Defendant argue that the lower court committed an error in not giving them at least twenty-four hours after arraignment to answer to the complaint. It is true that section 19 of General Orders, No. 58, gives the Defendant the right, on arraignment, to require a reasonable time, not less than one day, to answer the complaint or information. It is true, in the present case, that the lower court refused to give then in this one day in which to answer. The attorneys for the Defendants, however, expressly renounced the right to present any dilatory exceptions, and four days after the commencement of the trial and after they had ample time to examine the complaint, each of one of them voluntarily withdrew his plea of “not guilty” to the said complaint; the error of the court, therefore, if there were any, could not in any way have prejudiced them. The record fully discloses that each of the Defendants was a chief and organizer of bands of bandits and that, therefore, the punishment imposed by the lower court was entirely justified by law. (U. S. vs. Oruga, 1 5 Off. Gaz., 161. ) After a full consideration of all the facts presented to this court, we are of the opinion that the sentence of the lower court should be affirmed, and it is so ordered, with costs. Arellano, C. J., Torres, Willard, and Tracey JJ., concur. The Macario Sakay Biography: Sakay was born on January 3, 1870; he was a native of Tondo, Manila where he worked as a barber. An original member of the Katipunan movement, he fought alongside Andrés Bonifacio throughout the Philippine Revolution of 1896. In 1899 he continued the struggle for Philippine independence against the United States. Near the end of the Philippine-American War Sakay was captured and jailed by the Philippine Constabulary. After the surrender of the last Filipino commanding general Miguel Malvar in April 1902, President Theodore Roosevelt officially ended the Philippine-American Waron July 4, 1902. At the end of the war, Sakay was granted amnesty and released from prison. Macario Sakay y de León was a Filipino general in the Philippine Revolution against Spain and in the Philippine-American War. According to some historians, He may have been a president of the Philippines but is currently not recognized as such by the Philippine government. He continued resistance against the United States following the official American declaration of the war's end in 1902 and in the following year became president of the Tagalog Republic. Sakay was conned by the Americans into coming down from the mountains on promise of amnesty for him and his officials, on top of the formation of Philippine Assembly composed of Filipinos to serve as the 'gate of freedom. His surrender was made to be a prerequisite for a state of peace that would supposedly ensure the election of Filipino delegates to the Philippine Assembly. Sakay believed that the struggle has shifted to constitutional means, with the Assembly as means to winning Philippine Independence. Dominador Gomez, a Filipino labor leader, was authorized in 1905 by Governor General Henry Clay Ide to negotiate for the surrender of Sakay and his men. Gomez met with Sakay at his camp and argued that the establishment of a national assembly was being held up by Sakay's intransigence, and that its establishment would be the first step toward Filipino independence. Sakay agreed to end his resistance on conditions that a general amnesty be granted his men, that they be permitted to carry firearms, and that he and his officers would be permitted to leave the country. Gomez assured Sakay that these conditions the would be acceptable to the Americans, and Sakay's emissary, General Leon Villafuerte, obtained agreement to them from the American Governor General. Sakay and Villafuerte traveled to Manila, where they were welcomed and invited to receptions and banquets. One invitation came from the Constabulary Chief, Col. Harry H. Bandholtz. That invitation was a colonial trap and Sakay and his principal lieutenants were disarmed and arrested while the party was in progress. He was accused of "bandolerismo under the Brigandage Act of Nov. 12, 1902, which interpreted all acts of armed resistance to American rule as banditry." The colonial Supreme Court of the Philippines upheld the decision. On September 13, 1907, the leader of the Republic of Katagalugan, the de facto fourth President of the Philippines, was hanged. Before his death, he made the following statement: Death comes to all of us sooner or later, so I will face the Lord Almighty calmly. But I want to tell you that we are not bandits and robbers, as the Americans have accused us, but members of the revolutionary force that defended our mother country, the Philippines! Farewell! Long live the Republic and may our independence be born in the future! Long live the Philippines!" Sakay was one of the founders of the Nacionalista Party, which strove for Philippine independence though legal means. The party appealed to the Philippine Commission. However, the Commission passed the Sedition Law, which banned the party. (An unrelated Nacionalista Party which survives to the present day was founded in 1907.) Sakay thus took up arms again. On November 12, 1902, the Philippine Commission passed the Bandolerism Act which proclaimed all captured resistance fighters or insurgents to be tried in court as bandits, ladrones, and robbers. In April 1904, Sakay issued his own manifesto proclaiming himself President and established his own government called the Repúblika ng Katagalugan (Tagalog Republic) in opposition to U.S. colonial rule. The U.S. Government did not recognize Sakay's government and, through the Bandolerism Act, labeled him an outlaw. The Governor General, the U.S. Government, and the U.S. military left the pursuit of Sakay in the hands of the Philippine Constabulary and Philippine Scouts. In 1905 concentration camps, often referred to as Zonas, were re-established in parts of Cavite, Batangas, and Laguna. This had little effect on Sakay and his fighters. Entonces fue también desmenuzado el hierro, el barro cocido, el metal, la plata y el oro, y se tornaron como tamo de las eras del verano; y levantólos el viento, y nunca más se les halló lugar. Mas la piedra que hirió a la imagen, fue hecha un gran monte, que hinchió toda la tierra. Daniel continuó diciendo: "Tú, oh rey, eres rey de reyes; porque el Dios del cielo te ha dado reino, potencia, y fortaleza, y majestad. Y todo lo que habitan hijos de hombres, bestias del campo, y aves del cielo, él ha entregado en tu mano, y te ha hecho enseñorear sobre todo ello: tú eres aquella cabeza de oro. "Y después de ti se levantará otro reino menor que tú; y otro tercer reino de metal, el cual se enseñoreará de toda la tierra. "Y el reino cuarto será fuerte como hierro; y como el hierro desmenuza y doma todas las cosas, y como el hierro que quebranta todas estas cosas, desmenuzará y quebrantará. "Y lo que viste de los pies y los dedos, en parte de barro cocido de alfarero, y en parte de hierro, el reino será dividido; mas habrá en él algo de fortaleza de hierro, según que viste el hierro mezclado con el tiesto de barro. Y por ser los dedos de los pies en parte de hierro, y en parte de barro cocido, en parte será el reino fuerte, y en parte será frágil. Cuanto a aquello que viste, el hierro mezclado con tiesto de barro, mezclaránse con simiente humana, mas no se pegarán el uno con el otro, como el hierro no se mistura con el tiesto. "Y en los días de estos reyes, levantará el Dios del cielo un reino que nunca jamás se corromperá: y no será dejado a otro pueblo este reino; el cual desmenuzará y consumirá todos estos reinos, y el permanecerá para siempre. De la manera que viste que del monte fue cortada una piedra, no con manos, la cual desmenuzó al hierro, al metal, al tiesto, a la plata, y al oro; el gran Dios ha mostrado al rey lo que ha de acontecer en lo por venir: y el sueño es verdadero, y fiel su declaración." Pero en la Palabra de Dios se descorre el velo, y encima, detrás y a través de todo el juego y contrajuego de los humanos intereses, poder y pasiones, contemplamos a los agentes del que es todo misericordioso, que cumplen silenciosa y pacientemente los designios y la voluntad de él.

No. 3621. July 26, 1907.] THE UNITED STATES, Plaintiff-Appellee, vs. MACARIO SAKAY, JULIAN MONTALBAN, LEON VILLAFUERTE, and LUCIO DE VEGA, Defendants-Appellants). The Judge: Ignacio Villamor (eventually became Associate Justice Ignacio Villamor; Tenure: May 19, 1920 - May 23, 1933. Appointed by: Woodrow Wilson Birthdate: February 01, 1863; Place of Birth: Bangued, The Supreme Court Chief Justice: Cayetano L. Arellano (March 2, 1847 – December 23, 1920) was the first Chief Justice of the Supreme Court of the Philippines under the American Civil Government. He was Chief Justice from 1901 until his retirement on April 12, 1920, making him the longest serving Chief Justice (Many historians doubt the legacy of Arellano, for being one of the persons who literally 'placed' the Philippines under American Rule, he was considered a lackey of the American rule in the Philippines. It was shown that he was pro-American from the start. The Decision: These Defendants were charged in the Court of First Instance of the Province of Cavite with having committed the crime of bandolerismo, as follows: “That the said Macario Sakay, Francisco Carreon, Julian Montalban, Leon Villafuerte, Lucio de Vega, Benito Natividad, Justiniano Ramos, Vicente Giron, Filomeno Peroy, Isabelo Despida, Felix Estacio, and Gregorio Porto, in and during the years 1902, 1903, 1904, 1905 and 1906, voluntarily, illegally, and criminally, organized bands of ladrones, in which organizations the said Macario Sakay was known as president, Francisco Carreon as vice-president, Julian Montalban and Leon Villafuerte as generals, Lucio de Vega as colonel, Benito Natividad, Justiniano Ramos, and Vicente Giron as majors; that the said bands of ladrones were each composed of more than three persons, armed with deadly weapons, and were organized by the accused for the stealing of carabaos, cattle, horses, rice, and other kind of personal property, and for other purposes, by means of force and violence; that the said bands of ladrones, organized commanded, and directed by the said accused, performed each and all of the aforementioned acts in the Province of Cavite, Batangas, Laguna, Rizal, and Bulacan; and that more especially they detained, tortured, mutilated, and purposely and treacherously killed some of the inhabitants of the said provinces. That the said accused, each and every one of them, cooperated and associated with said armed ladrones when the said bands operated under their command and performed the acts above related. All against the statute in such cases made and provided.” X X X X X X X X X X The attorneys for the Defendant argue that the lower court committed an error in not giving them at least twenty-four hours after arraignment to answer to the complaint. It is true that section 19 of General Orders, No. 58, gives the Defendant the right, on arraignment, to require a reasonable time, not less than one day, to answer the complaint or information. It is true, in the present case, that the lower court refused to give then in this one day in which to answer. The attorneys for the Defendants, however, expressly renounced the right to present any dilatory exceptions, and four days after the commencement of the trial and after they had ample time to examine the complaint, each of one of them voluntarily withdrew his plea of “not guilty” to the said complaint; the error of the court, therefore, if there were any, could not in any way have prejudiced them. The record fully discloses that each of the Defendants was a chief and organizer of bands of bandits and that, therefore, the punishment imposed by the lower court was entirely justified by law. (U. S. vs. Oruga, 1 5 Off. Gaz., 161. ) After a full consideration of all the facts presented to this court, we are of the opinion that the sentence of the lower court should be affirmed, and it is so ordered, with costs. Arellano, C. J., Torres, Willard, and Tracey JJ., concur. The Macario Sakay Biography: Sakay was born on January 3, 1870; he was a native of Tondo, Manila where he worked as a barber. An original member of the Katipunan movement, he fought alongside Andrés Bonifacio throughout the Philippine Revolution of 1896. In 1899 he continued the struggle for Philippine independence against the United States. Near the end of the Philippine-American War Sakay was captured and jailed by the Philippine Constabulary. After the surrender of the last Filipino commanding general Miguel Malvar in April 1902, President Theodore Roosevelt officially ended the Philippine-American Waron July 4, 1902. At the end of the war, Sakay was granted amnesty and released from prison. Macario Sakay y de León was a Filipino general in the Philippine Revolution against Spain and in the Philippine-American War. According to some historians, He may have been a president of the Philippines but is currently not recognized as such by the Philippine government. He continued resistance against the United States following the official American declaration of the war's end in 1902 and in the following year became president of the Tagalog Republic. Sakay was conned by the Americans into coming down from the mountains on promise of amnesty for him and his officials, on top of the formation of Philippine Assembly composed of Filipinos to serve as the 'gate of freedom. His surrender was made to be a prerequisite for a state of peace that would supposedly ensure the election of Filipino delegates to the Philippine Assembly. Sakay believed that the struggle has shifted to constitutional means, with the Assembly as means to winning Philippine Independence. Dominador Gomez, a Filipino labor leader, was authorized in 1905 by Governor General Henry Clay Ide to negotiate for the surrender of Sakay and his men. Gomez met with Sakay at his camp and argued that the establishment of a national assembly was being held up by Sakay's intransigence, and that its establishment would be the first step toward Filipino independence. Sakay agreed to end his resistance on conditions that a general amnesty be granted his men, that they be permitted to carry firearms, and that he and his officers would be permitted to leave the country. Gomez assured Sakay that these conditions the would be acceptable to the Americans, and Sakay's emissary, General Leon Villafuerte, obtained agreement to them from the American Governor General. Sakay and Villafuerte traveled to Manila, where they were welcomed and invited to receptions and banquets. One invitation came from the Constabulary Chief, Col. Harry H. Bandholtz. That invitation was a colonial trap and Sakay and his principal lieutenants were disarmed and arrested while the party was in progress. He was accused of "bandolerismo under the Brigandage Act of Nov. 12, 1902, which interpreted all acts of armed resistance to American rule as banditry." The colonial Supreme Court of the Philippines upheld the decision. On September 13, 1907, the leader of the Republic of Katagalugan, the de facto fourth President of the Philippines, was hanged. Before his death, he made the following statement: Death comes to all of us sooner or later, so I will face the Lord Almighty calmly. But I want to tell you that we are not bandits and robbers, as the Americans have accused us, but members of the revolutionary force that defended our mother country, the Philippines! Farewell! Long live the Republic and may our independence be born in the future! Long live the Philippines!" Sakay was one of the founders of the Nacionalista Party, which strove for Philippine independence though legal means. The party appealed to the Philippine Commission. However, the Commission passed the Sedition Law, which banned the party. (An unrelated Nacionalista Party which survives to the present day was founded in 1907.) Sakay thus took up arms again. On November 12, 1902, the Philippine Commission passed the Bandolerism Act which proclaimed all captured resistance fighters or insurgents to be tried in court as bandits, ladrones, and robbers. In April 1904, Sakay issued his own manifesto proclaiming himself President and established his own government called the Repúblika ng Katagalugan (Tagalog Republic) in opposition to U.S. colonial rule. The U.S. Government did not recognize Sakay's government and, through the Bandolerism Act, labeled him an outlaw. The Governor General, the U.S. Government, and the U.S. military left the pursuit of Sakay in the hands of the Philippine Constabulary and Philippine Scouts. In 1905 concentration camps, often referred to as Zonas, were re-established in parts of Cavite, Batangas, and Laguna. This had little effect on Sakay and his fighters.
