Kailian is an Ilocano word used to address or identify fellow members of a community, signifying something even deeper than "fellow Ilocano." This mirrors Marcos supporters' call for nationwide unity through the burial of the late president and veteran. Two unity masses were held in FEM's home province, at the San Agustin Church in Paoay and then at the St. John the Baptist Parish Church in Badoc. Governor Marcos shared to fellow Ilocanos that "President Duterte once again reiterated what he knew to be right as a lawyer: that my father, a soldier, a president, and a war hero, should be buried at the [LNMB]." Burying the late president at the LNMB had been one of his promises during the presidential campaign period, but cases filed at the Supreme Court led to the declaration of a temporary restraining order (TRO) on any burial preparations for Marcos. Marcos (FEM) to be buried at the Libingan ng Mga Bayani (LNMB) were formally submitted as a petition to t Read more ... he Supreme Court (SC) today, October 6, 2016. Marcos loyalists held a unity mass in front of the SC before the presentation of signatures, interceding for a positive response towards the cause of their petition. According to the Marcos heirs' lawyer Atty. Hyacinth Rafael-Antonio, the steady support for FEM even 27 years after his passing shows that "there are numerous Filipinos who are in favor of the burial of the late President at the LNMB." The entirety of the signatures are composed of those collected on-ground by loyalist and pro-Marcos groups as well as e-signatures gathered through a Change.org petition, "#ilibingNa si President Ferdinand Marcos sa Libingan ng mga Bayani." E-signatures were cross-checked with the tangible petition to make sure that one person counted as one vote. Within Metro Manila, it was loyalists like the United Marcos Loyalists in the Philippines (UMLP) and Friends of Imelda R. Marcos (FIRM) 24k, as well as other activist groups including the Kilusang Kaisipang Diwang Pilipino (KKDP) and Buong Bayan Magkaisa (BBM) Youth Movement who carried out the campaign. Meanwhile, former Kabataang Barangay (KB) officers such as Edward Chua of Leyte and Cris Lindo of Agusan del Norte led the collection of signatures in their localities. The campaign reached even Overseas Filipino Workers (OFWs) like those in Canada, Hong Kong, and Taiwan. Last September 18, Marcos loyalists from Australia paid a courtesy to Ilocos Norte Governor Imee R. Marcos, daughter of the late president. They had initially intended to fly home in order to attend Marcos' burial, before the temporary restraining order (TRO) was placed by the SC on burial preparations. Efforts for the signature campaign spanned a period of a little over one month, excluding international group BongBong Marcos Loyalists Movement, who had the initiative to begin collecting signatures immediately after President Rodrigo R. Duterte declared his favor for FEM's interment at the LNMB. Throughout the rest of the Philippines and other nations, "pro-libing" netizens shared the online petition link on social networking sites. The manifestation was filed by Atty. Hyacinth Rafael-Antonio, the lawyer of the Marcos family, as directed by Supreme Court (SC) Justice Alfredo Caguioa. Justice Caguiao asked the Marcos family to drop the planned burial of FEM at LNMB during the second round of oral arguments on September 7, 2016, saying, “if it is possible for the Marcos family to actually withdraw their petition in the face of all the pain and anguish expressed during the last hearing, as a sign of healing.” In the filed manifestation, Atty. Rafael-Antonio maintained that FEM’s burial at LNMB is in accordance with, and implements the law “and because of this the family does not wish to abandon this undertaking.” The burial of FEM at LNMB has been politically dividing the country for twenty-seven years now until President Rodrigo R. Duterte backed the plan as a fulfillment of his campaign promise, highlighting national unity and healing. Moreover, Atty. Rafael-Antonio pointed out that it is not only the Marcos family that is awaiting the burial of FEM at the LNMB, citing the letter of Suzette P. Pido, daughter of the late Colonel Ildefonso A. Perez who was incarcerated together with FEM in Capas, Tarlac during World War II. Despite being a war veteran and a soldier, Colonel Perez made it a part of his last will and testament not to be buried at LNMB until FEM “was allowed to be similarly interred within its hallowed grounds.” In her letter, Pido noted that her clan honors a “blood debt to Ferdinand Marcos” as her father personally witnessed the heroism and generosity of FEM who was then recognized as the “leader of men” during the war years. Pido recounted in her letter the story told by her father when “he met a certain Lt. Ferdinand Marcos.” “When this Lt. Marcos found out that my father’s brother, Sid was at death’s door, he unhesitatingly gave my dad a bottle of intravenous fluid (IV) that had been smuggled into the camp by his mother Josefa Marcos, for her son’s own use in case he, himself got sick,” she wrote. “While handing over the IV bottle…to a person he hardly knew, Lt. Marcos said ‘Your brother needs this more than me,’” she added. Pido’s Uncle Sid “recovered, prospered and lived to a ripe old age” and it is in this light that she sets aside her own political beliefs despite being an anti-Marcos advocate to fulfill her father’s dying wish. Despite the negative reports about Martial Law, Pido noted that his father “wanted us, his family, to recognize the fact that despite all that has been said about the man, for one instance in his life, Ferdinand Marcos was truly a hero.” Atty. Rafael-Antonio also noted that the Marcos loyalists showed their support for the burial of FEM at LNMB by peacefully demonstrating outside SC during the oral arguments, enduring the sweltering heat and intermittent rain. "Well settled is the rule that a mere existence of a controversy will not authorize the courts of its power of review," Calida said. "Instant controversy is beyond judicial review as it involves the intrusion into the wisdom behind the interment (Burial) of Marcos at the" Libingan ng mga Bayani (Heroes Cemetery). In their petition for Certiorari (a writ or written order of a superior court to call up the records of an inferior court or a body acting in a quasi-judicial capacity) and Prohibition with Application for a Temporary Restraining Order (TRO), victims said that the Department of National Defense (DND), the Armed Forces of the Philippines (AFP) and the Marcoses “ committed grave abuse of discretion amounting to lack or excess of jurisdiction in ordering and allowing the burial of the remains of Marcos at the national hero’s cemetery (Libingan ng mga Bayani).” Among the petitioners were National Artist Prof. Bienvenido Lumbera, Samahan ng Ex-Detainees Laban sa Detensyon at Aresto (Selda) represented by Dionito Cabillas, Carmencita Florentino, Rodolfo del Rosario, Felix Dalisay, Danilo dela Fuente, Bayan represented by Carol Araullo and Trinidad Herrera Repuno. The respondents named in the petition were AFP Rear Admiral Ernesto Enriquez, AFP Chief of Staff Gen. Ricardo Visaya, DND Secretary Delfin Lorenzana, and heirs of Marcos represented by his wife, Imelda Marcos. MARCOS BURIAL AS "HERO" VIOLATES EXISTING LAWS The petitioners said the planned Marcos burial is prohibited by Republic Act 289, which states that the purpose of the construction of "Libingan ng Mga Bayani" (Heroes Cemetery) is to perpetuate the memory of presidents, national heroes and patriots for inspiration and emulation of the present and future generations. In addition, it violates Republic Act 1038 or the Human Rights Victims Reparation and Recognition Act of 2013, which enshrines into law the recognition of the human rights violations committed during the Marcos regime and the moral and legal obligation of the State to recognize and provide reparation to the victims. “Una, labag sa batas ang paglibing dahil ayon sa batas ang ilibing doon ay worthy of emulation (effort or desire to excel) and aspiration... at si Marcos dahil sa human rights violations niya at plunder ng panahon nung Martial Law at grabe ang kahirapan nu’ng panahon ng Martial Law.
